Fail to Connect / BB Bold / Telefonica

searching the forum it looks like that 'Fail to connect' is not a great issue anymore, but it is for me so I hope you can help.
I have a BB Bold 9000 (bought from Expansys), unlocked, running on Telefonica(Movistar), sw V4.6.0.190 which I think should be the latest from Telefonica. But I have installed without the Telefonica Vendor.html file.
On 3G with full signal I 5 out of 6 times receive my voicemail when calling BB and I expect it is a result of fail to connect. If I force to 2G I have no issue.
I need the simultaneous mail and voice on 3G and also sometimes travel to Japan where only 3G is available - so I don't know what to do:
a) Update SW?
b) return HW (it is the second device i have)
If I should perform a) which SW platform will you recomend?
