If they are truly production units and just unbranded, you should be fine. If they are RIM test models, then they will probably be locked out by RIM if they aren't already. If that happens, you will never be able to use them for email. By the looks of the picture and the sellers feedback, you should be fine. RIM test models wouldn't be in boxes. The ONLY thing you may have to deal with is if AT&T pushes the launch date back. If you buy one, you may not be able to use it on AT&T's network until they officially launch on AT&T and the service books are available. But once they are, you will be good to go. Good luck.

even though its unlocked, it looks like a t-mobile branded phone. so doesnt that mean the 3G wont work on att?

The frequencies shown reflect ATT. But it is eBay.
