Default Bedside turning itself off?

I have seen several posts about the screen going blank and bedside not working, but I can not find anyone having the same problem I am having.

I put the torch in the cradle (or just plug it in) and it goes to the normal clock as I set it to do. I then select bedside mode and the message "entering bedside mode" comes up, then when it goes away the menu keys at the bottom go dark and the back light fades to very dim - which is perfect. Then as soon as it gets all the way down to the dimmest setting - it snaps back to the normal clock brightness and the keys (I am talking about the phone buttons - not the keyboard - it is closed while i do this) light up again. This happens with the torch plugged in or not, with a program open or not - etc. The notifications and ring tone stay as I have them set under bedside - so I know it is still active, but the dim back light and dark keys will not stay in place. Does not matter if I am in a fully lit room or dark room. I am not touching or moving it at all when this happens.

Anyone else have this problem? I travel a lot and love the bedside mode, but this makes it bright enough it lights the whole room up.

Cannot seem to figure this one out and even goggle cant find anyone else with this problem, unless I am just not using the right words.

Any thoughts?
