the other day my keypad went haywire it wasnt allowing me to do anything. for example if i hit delete while texting letters/numbers would be inserted. i called and issued a claim and after paying the deductible was sent a new phone since i have insurance. a day later my phone started working just fine and has been since. i now have received the new replacement and not sure what to do. could i sell my old one and keep the newer or is this considered insurance fraud?

Probably would need a lawyers read on the details but I would say you are ok. There is no gaurantee that your phone won t act up again. No if you sell it as an operating model free of defect, then that is probably fraud

you can always return the insurance replacement and they should credit the insurance deductible. you should definately call them first to let them know. Also, sounds like your phone acted up due to a manufactuer defect, you should be able to get that replaced w/ warranty and not end up having to pay the deductible...

reason i had to pay a deductible is i had aquired the phone from a phone trade so the warranty was void.

so i'd have to list it as for parts or something? what if whoever buys it uses it as is. would the pin be recognized and then i'd have people coming after me or something?

i think if you sell your original phone and keep the insurance replacment, then you should be fine. you can just sell the old phone on like craigslist and just make sure you wipe the whole device. it would probably keep good to mention that the device is used... and I'm sure you would be in the clear. I'll buy it for $50 if you want... LOL

Most insurance companies require that you return the old "non working" device if you do not they will charge you full retail for the replacement! Make sure before you go selling because that would be considered fraud

AND like EZ said, you might be paying full retail if you don't return it. Of course you can wait a couple months and see if it shows up on your bill, then what will you do?

Just do the right thing and return it.
