I have a blackberry oem case I had bought for my Storm and now I have a Tour and it fits perfectly but it doesn't put the phone to sleep like its suppose too. What's going on? I'm sure its not a setting on the Tour itself, I've never seen one.

Same here. The Tour and Storm cases don't appear to be interchangeable between devices.

I think u read the question wrong. Its not that the device doesn't fit in the case, its that the case itself for some reason must have the magnets in a different position or something that's not contacting in the right way with the Tour.

The magnet needs to be closer to the bottom of the Tour to work. The Storm needs it more to the middle. Move a magnet around on the Tour and see where it is when the screen shuts down.

Nope didn't read it wrong, I am agreeing with you.

I am using both the Storm and Tour and have OEM cases for both. Although they do fit, as you said, the magnets don't align to enable power save so you can't use a Storm in a Tour case and vise vera without higher battery drain.
