Well, I guess I shouldn't say "you", but law enforcement can. A BBM message is comprised of packets, which can be sniffed out and decrypted by the three-letter agencies, and the messages can also be requested from RIM with a warrant.
Tracking a person's movement doesn't even require them to send a message though because as soon as the device attaches to a mobile network it can be triangulated by both the cellular signal as well as the IP address that the device receives. Sending messages just makes the IP triangulation easier.
