BT and Voice Command Issue

I am having a very reoccuring problem, 60-70% of tries, when I try to use Voice Command with Jawbone BT. It gets to the point where the Nuance program normally hands the call over to the phone but it just stops. It doesn't freeze because all I have to do is hit END and I can try again. Have replace phone twice and BT twice. Problem started after upgrade to 5.0.0.328.
RIM says it is because BT is not certified compatible with BB. It just doesn't seem like a BT issue. No other BT issues. It seems like a Nuance software issue. Any ideas.
