Default Blackberry 9700 & 3G question

Hi,
I have the T-Mobile Blackberry 9700. I use the 3G and UMA features. Since I live in New York City, there is 3G everywhere I go with T-Mobile.
During the day I am in an area where there is slight network congestion. This causes my phone call to roll over to EDGE or GPRS while in the middle of a phone call, thus causing me to loose the ability to talk and surf at the same time. The call does not cut out at all, it just does that for some reason, and I can see that from other forums, people have stated the same issue.
Some carriers allow the user to choose between 2G, 3G and 3G/2G mode. I only have the option for 2G and 2G/3G mode. I want the ability to get 3G mode only and force everything to use 3G. (By the way, my calls do not cut out, so it's very odd that it moves over the GPRS).
If I take the OS from another carrier (that lets you choose 3G only), delete that XML file and load it to this Blackberry, will I have the ability to choose 3G only mode? Additionally, will this cause my UMA to stop working? Moreover, if this works, would anyone know which carrier gives these options? I think Rogers Wireless is one of them. Lastly, if I need to do a warranty exchange, would I be able to go back to the T-Mobile loaded OS without issues? I assume that the OS I'd be loading would be a higher version, and would hope that Desktop Manager would let me downgrade.

Probably not. I remember with AT&T Bold 9000's the inability to turn off 3G was hard coded into the device. Even when folks put a different carrier's OS onto their Bolds they were still restricted from turning off 3G. I had a Roger's Bold 9000 unlocked that I was using on AT&T, and I was indeed able to turn off 3G if I was looking to save battery power. This made a difference in poor coverage areas.

It all depends on how T-Mobile implemented this restriction.
