Yes, it's illegal to sell something you can't deliver, it's called "stealing."

Wouldn't that make pre-ordering anything (video games, cell phone from the carrier, movies) illegal if that were the case? Those places (including Wal-Mart) are selling you something they dont have yet, but are planning on getting when available.

Yeah but in the case of ebay, I always thought those types of auctions shouldn't be allowed. I believe if you win an auction or do a 'buy it now' you have (3) days to make payment and then the seller has (3) days to ship or deliver the item.

Of course, there's probably a loop hole that says if you state in the auction actual ship times, it's okay. Ugh...

Ask seller a question: Do you have it now? If no then you're foolish to bid. If yes then why shouldn't they ship within 3 days? The going price is about $600 so this is no bargain anyway, right?

Do not wait on eBay to police it's site!

The USA has crap for hardware because of the FCC.

I have emailed the seller three times and would pay the $900+ for the phone but he will not reply to confirm that the item is in his hand and ready to ship nor will he list what exactly is included with the phone. I would also like to see a real image of his devices and yet he only has a stock photo in the auction.

Close but no Bold for me!

I live in Seattle, and I noticed he is in Seattle, so I emailed him and asked if I purchased one, could I pick it up, or meet him somewhere to save on shipping, here is the response I got " No, they come from our Hong Kong Warehouse so you cannot!

I wrote him a message and got this response:

This phone should start shipping early next week. We ordered 60 Units from Blackberry and they are on the way, now they are in Customs, Release date is Monday, so we hope we will start shipping them early next week.

I, too, got the same email to all three of my questions to him. I am thinking he is legit and accrding to his eBay feedback is doing what he does for a living. The only risk would be if they do not clear customs and I am betting this guy would get them to clear or refund the buyer his money. Customs waiting for release where, to Hong Kong?
