Agreed. I wouldn't even mention the working without sim card thing for the simple fact that they might just try to fix it and send you a crap phone in the mean time. Say that it doesn't work and follow all their steps (water damage stickers, serial number, imei, etc). Also, see if you can get it replaced for free under RIM's Warentee as the carrier will charge you around 50 for a replacement
