wifi with no data plan

BB Curve 9300 connected to home Wifi. Carrier is at&t but no dataplan of any type.
I installed Opera Mini. I removed the simcard and I turned "Data Services" on. Opera Mini connected to the Internet.
When I checked my IP at an online site from Opera, it was 141.0.8.173, which is completely different than my WAN IP. (iPad and Laptop shows my WAN IP).
On my BB, the wifi icon is on and there is an "SOS" next to the network antenna in the upper right hand corner.
With my SIM card out, there is no way I could be charged for data usage, right? I am concerned because, a couple of months ago, at&t turned on my dataplan for some reason unbeknownst to me, although I suspect it was due to my turning on an Internet app in my BB. Not sure. When I got the bill, I had them turn the data plan off.
Why is the WAN IP entirely different than my WAN IP?

AT&T typically scans their network to see if there is a device without the proper data plan. If one is found, the data plan will be added. If you have a SIM in your device, then it will be detected and the data plan will be added, whether you want it or not. Verizon does the same thing. That is why you had one added to your account. Next time, they may be so lenient.
The IP you are seeing is probably the proxy that Opera uses.
As for data, if you are connected to WiFi,all data goes that way. "SOS" means you can only make emergency (911) type calls.
Keep in mind, without the BB data plan, you will not have the proper service books activated and you won't have access to any RIM services such as email, FB, BBM, etc. Since you had a dataplan at one time they may work for a while, but will be disconnected.

OK. So with no simcard installed, no connection is being made to at&t. With that advice, I will try using LogicMail to see if it works as well as Opera does over wifi. I didn't want to press my luck, not knowing why the data plan had been turned on previously.
What I would like to do is use nothing but wifi and voice. But, to do that, I need my simcard inserted to use voice and have "Data Services" turned on to use wifi. And I suppose that means that I would risk at&t turning on my dataplan as soon as I plugged in the simcard and used wifi. I guess you can't ask at&t to block the dataplan from being turned on?

To repeat what Dubdub wrote above and make sure it is clear, having data services on while connected to the mobile network is not a factor. The carrier sees what device is connected, regardless.

OK. thanks. So when at&t does their periodic scans, they will determine a blackberry is online without a dataplan. The fact that you might have Data Services turned off, is beside the point. Great.
So I will give them a call and ask them to block the dataplan. Of course, that will likely do no good. Up until now, I had been using an 8310 for a couple of years with no data plan until 2 months ago. At my request, they did shut the plan off and give me a full credit. Any idea why they were so lenient with me? That is why I had assumed that as long as I left Data Services off, I would be OK. The 8310 does not have wifi, so I had no reason to turn data services on.
by the way, LogicMail worked fine on wifi.

You will not be OK. The scans go by IMEI, and your device will show as a BlackBerry and the plan will be added. You may have gotten away with it before because you were grandfathered.
LogicMail is also not the same as BlackBerry e-mail.

As of September 2009, AT&T requires a data plan for BlackBerry devices and smartphones activated on their network.
As you were told in your previous thread, you need a data plan.

If at&t requires a dataplan for the 9300, I'll go back to the 8310 for now. Like you say, maybe I am grandfathered. I am not sure when it was that I first got the 8310. Maybe it preceeded the data plan requirement.
The reason I loaded Opera Mini and LogicMail was because they both work with wifi in the 9300 without the dataplan. Both work with no simcard. However, the BB Broswer is also working. I thought I read that Opera Mini was required if you needed a wifi connected browser with no data plan.
I will call at&t tomorrow to find out whether they will require a data plan if I switch to the 9300.

You keep jumping to unfound conclusions. The AT&T policy applies to smartphones and not the particular model, at least so far as I understand. The reference to you perhaps being grandfathered was to a contract and not the model smartphone.
At any rate, no one here knows for sure exactly why the data plan wasn't pushed on you earlier, or why the AT&T rep removed it when you asked. You need to talk to AT&T customer service and go over your situation with them and figure out where you stand.

Sorry if I mis-understood the reference to IMEI. I do know that I have been using blackberry phones for about 10 years or so. For the first 5 or 6, I had a dataplan. I dropped it in 2007. It remained off until a couple of months ago. I didn't ask at&t why it was back on, I just requested it be turned off. I didn't know it had been turned on until I got the bill. I never intentionally used the Internet connection. If the grandfathering is to the contract and not the IMEI, I should be fine switching to the 9300. Great!
I'll let you know what they tell me tomorrow.

Good luck. A bit of advice, don't assume things when talking to AT&T. Anything that isn't exactly, positively clear, repeat it back in your own words and ask for confirmation.

If your previous device was activated prior to 2009, then it did not require a data plan.
Any BlackBerry activated after that will envoke the requirement.

Yes, if you activate a new DEVICE, then the data plan likely will be triggered.
What you had previously is irrelevant.
