Default Asurion Insurance Situation

Please Login to Remove!

Hello everyone,

This is my first post so I hope this is in the right spot.

I recently thought I lost my Blackberry Bold. I initiated the insurance deal and they shipped one out to me. A couple days later I found my phone! I was very happy! Now I don't need the replacement phone and I don't have to pay the $125 deductible.

WRONG! I called up Asurion to be honest and do the right thing and they are telling me to ship them the phone I found and STILL pay the deductible. Now, this just doesn't seem fair. I'm still fighting with them about it. Has anyone else found themselves in this situation?

Thanks for any advice/help you can give. I just want to mail back the replacement and pretend like this never happened...

Call them back and say the phone you found was not yours and sell that one on craigslist to cover deductable. That is not right at all.

Are you serious?
You filed an insurance claim, paid your deductible already, and received your replacement. You don't "undo" that.

Send the "lost/found" device back to them as they're requiring you to do.
If you don't, you're guilty of insurance fraud.
Send it back, and be done with it.

(And the post above mine is also insurance fraud. I suggest you ignore it.)

I had the same scenario with my Curve last year. They asked for the "found" device to be returned to assure that I hadn't requested a replacement because of possible water-damage or that I'd perhaps broken it. I sent it back to avoid insurance fraud then called Sprint to complain. They credited my account the $50 deductible that I'd paid. Sure, it was Sprint that issued the credit and not the insurance company, but I was satisfied all the same...

I can see not wanting to commit fraud. But they have no right to charge you and get your old phone. You are paying 125 bucks for no reason at all. I would do what angie did and call carrier and complain and hope they credit you.

Yeah...and stick some poor fool with a non functioning device since it's on the lost or stolen list. Bad advise.


Once they have given you a new device, they own your old one. The deductible is to insure that people don't attempt to defraud them by making a false report to get a new phone just because they broke their old one.

The same thing would happen if you reported your car stolen. If they cut you a check, they own your car if it's found. Of course with auto insurance you can bet they are going to invstigate it thoroughly to make sure you didn't just report it stolen because it broke down on ya and you wanted a new one..lol.

What planet do you live on? Do you even know how insurance works?
The $125 is the deductible on the insurance coverage. It's not "no reason at all".

Hey everyone,

Thanks for the responses. I just want to point out I understand the point of the deductible. It just seems to me that because I haven't used the replacement device at all, it is still sitting in the box in which it was shipped, I should be able to return the device and not be charged the deductible.

Does this sound crazy?

The problem, as penguin3107 and barbwyr have pointed out, is that a claim has been filed, processed, and you have received your replacement. The lost phone became the property of the insurance company at that point. So, the phone you found was, in fact, the insurance company's phone not yours. They just want their phone back.

So, what's done is done. Send the old phone back to the insurance company. Keep the replacement that you have received as a result of your claim. Enjoy the phone. Move on. It's really as simple as that.

My guess would be that you have never read an insurance document that you have probably agreed to abide by. They have every right in the world as that is what the "fine print" states.

The OP excercised the insurance and agrees to abide by the agreement.

I agree it doesn't seem fair in some ways, but that is what this insurance requires.

If people take the time to actually read their 'phone insurance', you will have to pay the deductible, PERIOD. You made a claim for loss, damage, whatever. You find the phone (or it starts working again), and it's THEIR phone, not yours legally.

Read the fine print before you sign anything, folks.

While it sucks (that you found your phone) that's the way it works. Maybe you should have looked a little harder for your phone before filing the claim. Just take it as a learning experience. We've all had to swallow a bitter pill in our lives....just move on and don't fret about it too much.

You're funny! We all have those days when acts we deem unfair can throw us into situations where we make bad judgement calls. We understood you and your comments actually added color to the thread. For what it's worth, I appreciate this. It's not too often (enough) that people can be decent and admit mistakes. And yeah, I've been there too... posting when angry. It can be fun, but usually just turns out to be a really bad idea.
