So, I'll summarize. The OP has what is apparently a defective device, but (for reasons I don't completely follow) is not capable of or able to return it to the seller for a refund or an exchange.

Either that or a defective battery. If I were him, I would start there. Or maybe go on a forum and rant, which would probably fix my issue just as well.

I have had three replacement batteries for the device one from o2 themselves one from amazon and the third from another o2 shop, and by the way, At no point have i said that this website was affiliated or connected to RIM in any way so I'll just quote the sentence that I've requested the answer to, "so i now challenge any one to answer with a fix or explanation with a reason as to why the piece of hardware itself would overheat for no reason and drain battery at such a fast rate" and as the title of the topic is "Blackberry 9320 BAD PROBLEMS!!!! NO-ONE can answer", to be honest without being an expert i wasn't expecting many people to reply WITHOUT an answer or a fix to the problem i have.

There isn't a fix if it is a defective device, not anything you can do at least. Maybe it can be repaired. No way of knowing without having someone qualified and with device in hand diagnose it.
If you bought from a legit seller and the device is in warranty, the solution to your problem would be to exchange the device. From your story, you can't do that.
I've assume the device has been like this from the start, that it is defective. But looking at your post again it seems it was ok the first week. Apps sucking resources and hitting the network will run the battery down fast a can make the device warm to the touch. What troubleshooting did you do? You might want to do a security wipe and select to delete user installed apps. Do a full backup first. After the wipe, test for 24 hours before you install or reinstall any apps. You can selectively restore your data like address book and so forth, but do your settings over, and don't install any apps until you test for a while. If the battery is still running down fast and the device heating up, you have a hardware issue.

People are far less inclined to help you with that attitude. I'm not preaching, just stating fact.
The reason your device is overheating is either a hardware malfunction or less likely, a problem with the OS, as happened with my 9330 when I first got it.
When you replace a battery, you must make sure it is an official BlackBerry product. There are plenty of knock-off batteries online, and they're garbage.

Well to be completely honest i have been dealing with this crap for a while, I don't necessarily mean to come across in an aggressive/ill mannered way it's just extremely frustrating when something you've spent money on cannot be exchanged or fixed and only then you'll suddenly realize that your attitude will slowly deteriorate.

The carriers can be very unhelpful. That is no surprise. If you have no documentation of your purchase, however, there's no one to blame but you.
Try the security wipe first. If that doesn't work, either reinstall the OS or intall the latest OS available for your model. You could skip to installing the latest OS but that isn't without risk.
If you've already tried the advice given above, tell us what you found.

If you got the phone recently from either o2 or tesco. You can contact Blackberry UK support team by going to their website and explaining all your worries. Make sure you have your IMEI and be sure your phone was purchased less than two years.
