Actually it sounds like the OP is still within the 30 day exchange period (she said she only had it two weeks) and is hoping to exchange it for the new Torch (since she said she wants the newest one). This is allowed by AT&T (for a small fee of course) so she's not trying to cheap them but take advantage of the 30 day exchange. However she is concerned because of the water indicator which would void the whole deal.
OP, you can try but most likely, you will be told the phone is no longer in the same condition your received it so you won't be able to exchange.
