Not to contradict John, but
Data Connection Refused simply means
you do not have a BlackBerry Data Plan and has nothing to do with the phone. Get a data plan from your provider.
At some point RIM did release a version of the OS (I think it was shortly after the Pearl was released) that had the Phone App unchecked by default!!! If you went to update the firmware, it would remove the Phone! As John said, try reloading the OS and make sure the Phone App is checked (later versions typically have this checked and you can't uncheck it!).
If John is right and the phone was restricted by IT Policy, follow his excellent directions.
