Phone's backlight won't turn off!

I'm not talking about the screen, but the buttons and the trackball. Usually, when I put my BB in standby mode, the buttons turn off. Then about a week ago, they stayed on. The trackball's light (is it an LED?) is staying on as well as the key lights. I feel if I don't fix this, the lights will burn out so much faster, and I've already had to go through one replacement BB (which was a JOYRIDE I tell you).

However the weird part is that I decided to turn my BB off to turn the lights off. But, lo and behold, the lights stayed on. The only way to turn them off is to take out the battery.

Is this a hardware problem or a software one? Any help is greatly appreciated!

certainly a hardware problem what i can understand.
the Lights are controlled by some sensor in screen and if it fails it will not be able to detect when to switch on and when to turn OFF.]

you can try to upgrade the software to latest version but

you seem to be ready for another joy ride (replacement)
