if by some far fetched chance rimm is issued an injucntion and their work around is found to also infringe on ntp patenets, will US carriers suchs Nextel give thier customers who are using blackberrys personally, a rebate or sumthin to get a newphone? if that was confusing my questionn is i bought, and pay for my bb out of my pocket not through a corporate account what am i supposed to do if they pause rimms work around as well as their primary push ssytem

According to all the media reports, the major wireless carriers have a plan if an injunction is put in place. Have no idea what their plans are.

Their plans are to use the workaround provided by Rim.

i understand that...im just curious in the far off chance that ntp succeds in getting an injunction on the work around as well then what. i mean i love this thing but imnot gonan keep it if i cant use the email feature

I will not listen to the Blog. I think the workaround ahs been put for a review and even the Judge commented that RIM can go to it if the shut down occures. If there was a chance of this happening, NTP would have gone for it to make it real hard and close all the possible exits for RIM.

Don't worry about a shutdown, in the event hell freezes over, there is always money and RIM has plenty, just doesn't want to waste it. For me, a personal user, I would rather go without for a month than jump ship. Yes, I can't get my email at work or on the road, which I love, but I can get them online, so it really wouldn't be that bad for me. Maybe I might have to actually start talking to people again, now that is scary :)

yeah im not concerned that there will be a shutdown at all its just one of those as u said hell freezing over scenerios like anybody think carriers will offer a discount or something

So if there happens to be a shutdown, will the device still work as a phone w/sms and the internet browser? Or would the whole device be useless?

I think the patents are all only tied to the "Push" email and for that matter I think how it works for BES users. I keep seeing/hearing that it may only really apply to BES and not BIS/redirector. I am likely hearing that wrong but it's very convaluded and getting no more clear daily.

I agree with conehead (Mitch :-) ) that the shutdown is VERY unlikely and I would also wait several months before switching devices. Not sure I would even switch to another email device and would just use the phone and PIM functions minus email.

In the event of a shutdown (which will NEVER happen, Hell does have a better chance of freezing over), the device would still work as a phone, sms, browser might be iffy, but the patents have nothing to do with the browser, only email, so it should still work too. Only email should be affected, nothing more.

I don't doubt that the judge might issue a injunction, I don't doubt that appeals will happen if he does, I don't doubt that the federal government might get really involved, I don't doubt that RIM might impliment it's workaround and NTP would sue again. But after all that happens, the worst case senerio would be at 11:59pm RIM would pay NTP a billion dollars to go away and no service disruption would EVER happen.

The really sad part is this would be a bigger crime than the UK robber last week, they only netted $100M and some of them, if not all are going to jail.
